Personal GPS Tracking products are warranted to be free from defects in materials or workmanship for six months from the date of purchase. Within this period, EyE-Watch will, at its sole option, repair or replace any components that fail in normal use. Such repairs or replacement will be made at no charge to the customer for parts or labour, EyE-Watch will not be responsible transport or couriers cost. This Limited Warranty does not apply to:
- cosmetic damage, such as scratches, nicks and dents;
- consumable parts, such as batteries & straps unless product damage has occurred due to a defect in materials or workmanship;
- damage caused by accident, abuse, misuse, water, flood, fire, or other acts of natural or external causes;
- damage caused as a result of wear & tear
- damage caused by service performed by anyone who is not an authorized service provider of EyE-Watch;
- damage to a product that has been modified or altered without the written permission of EyE-Watch,
- damage to a product that has been connected to power and/or data cables that are not supplied by EyE-Watch. In addition, EyE-Watch reserves the right to refuse warranty claims against products or services that are obtained and/or used in contravention of the laws of any country. This product is intended to be used only as a Monitoring aid and must not be used for any purpose requiring precise measurement of direction, distance, location or topography. EyE-Watch makes no warranty as to the accuracy or completeness of Map Data.
This Limited Warranty also does not apply to, and EyE-Watch is not responsible for, any degradation in the performance of any EyE-Watch product resulting from its use in proximity to any handset or other device that utilizes a terrestrial broadband network operating on frequencies that are close to the frequencies used by any Global Navigation Satellite System (GNSS) such as the Global Positioning Service (GPS). Use of such devices may impair reception of GNSS signals.
This warranty does not apply to any non-EyE-Watch branded hardware products or any software, even if packaged or sold with EyE-Watch hardware. Manufacturers, suppliers, or publishers, other than EyE-Watch, may provide their own warranties to you but EyE-Watch, in so far as permitted by law, provides their products “AS IS”. Software distributed by EyE-Watch with or without the EyE-Watch brand (including, but not limited to iOS or Android software) is not covered by this warranty. EyE-Watch does not warrant that the operation of the EyE-Watch Product/Software will be uninterrupted or error-free. EyE-Watch is not responsible for damage arising from failure to follow instructions relating to the EyE-Watch Product’s use.
All External factors such as GPS, AGPS, WIFI & LBS, will not be guaranteed or warrantied by EyE-Watch. In the event that there is inaccurate positioning data received from the Products current location, or data received on the Guardian/Parent Application, EyE-Watch cannot be held responsible for any external factors that may impede the performance of any product.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WARRANTIES AND REMEDIES CONTAINED IN THIS LIMITED WARRANTY ARE EXCLUSIVE AND IN LIEU OF, AND EYE-WATCH EXPRESSLY DISCLAIMS, ALL OTHER WARRANTIES AND REMEDIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, STATUTORY REMEDY OR OTHERWISE. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS. IF IMPLIED WARRANTIES CANNOT BE DISCLAIMED, THEN SUCH WARRANTIES ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
IN NO EVENT SHALL EYE-WATCH BE LIABLE IN A CLAIM FOR BREACH OF WARRANTY FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE MISUSE OR INABILITY TO USE THIS PRODUCT OR FROM DEFECTS IN THE PRODUCT.
Although every effort will be made to guard against loss of data, given the nature of often unknown, conflicting or corrupt software applications on devices, the possible loss of data or the functionality of the application cannot be guaranteed.
Repairs have a 90 day warranty. If the unit sent in is still under its original warranty, then the new warranty is 90 days or to the end of the original 6 months warranty, depending upon which is longer, not exceeding a total of 1 year. Refurbished products will also carry a 90 day warranty.
EyE-Watch retains the exclusive right to repair or replace (with a new or newly-overhauled replacement product or component ) the device or software. SUCH REMEDY SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF WARRANTY.
To obtain warranty service, contact EyE-Watch for shipping instructions. Securely pack the device in its original packaging, which is required as the proof of purchase for warranty repairs. Write the tracking number clearly on the outside of the package.
EyE-Watch cannot be held liable or responsible for products or services that have been Discontinued or otherwise, as stated by the Supplier as obsolete. Eye-Watch will maintain the original Limited Warranty, as described in this Limited Warranty document.
EyE-Watch, in the event that a specific product or Server Service is Discontinued or stated as Obsolete, by the Supplier, will have the right to either Offer a Paid Server Service or Discontinue the Product or Server Service entirely.
We will render support on a Carry-In basis for a total of 6 Months, after initial Limited Warranty has expired.
